Terms of Service

Babliy is a software service operated by Hamza Oblouch that helps businesses run AI employees, Company Knowledge, campaigns, and messaging workflows (including WhatsApp and other channels you connect). Babliy is not affiliated with Meta, OpenAI, Anthropic, Google, Slack, or other third parties whose platforms you may connect. Features may change as we improve the product.

Operator location: Agadir, Souss-Massa, Morocco. This is not a trade-register office address.

You must provide accurate information when registering and keep your credentials secure. You are responsible for activity under your account and for ensuring anyone on your team follows these terms.

You must be at least 18 years old and authorized to act on behalf of the business you register.

You retain ownership of your catalog, messages, customer data, knowledge files, and other content you upload or connect to Babliy. You grant us a limited, non-exclusive license to host, store, and process that content solely to provide and improve the service.

You are the data controller for your end-customers' personal data. You are responsible for having a lawful basis to message customers and for complying with applicable privacy laws. See our Privacy Policy for how Babliy processes data.

Connecting WhatsApp, Slack, Meta ads, Google, Cal.com, or other tools requires your compliance with those providers' terms. Outages or policy changes on their side may affect Babliy.

You grant Babliy permission to send and receive messages and call APIs on connected accounts only as you configure in the product.

• No spam, harassment, illegal goods, or misleading promotions.
• No attempt to bypass rate limits, scrape unrelated data, or compromise other accounts.
• No use of Babliy in ways that violate applicable law or third-party rights.
• Customer data must be handled lawfully; you are responsible for consent and opt-out where required.
• Do not use Babliy to make unauthorized medical, financial, or legal guarantees to your customers. AI output can be wrong.

Paid plans are billed according to the pricing shown at checkout, on the pricing page, or in your dashboard. Polar is the source of truth for the amount charged to your payment method. Local payment options (for example Cash Plus / Wafacash) may be offered in some regions.

New accounts may start with a free trial of 2 days and up to 20 conversations without a credit card where that offer is available. When the trial ends or limits are reached, you must subscribe to continue using paid features.

Subscriptions auto-renew each billing period until you cancel in Settings → Billing. You may upgrade, downgrade, or cancel at any time. Downgrades and cancellations take effect at the end of the current billing period unless stated otherwise in-product.

Prices exclude taxes unless stated at checkout. We may change pricing with reasonable notice. Continued use after a price change constitutes acceptance of the new price for subsequent billing periods where permitted by law.

Subscription fees are generally non-refundable except where required by applicable law or as described in our Refund Policy. Filing an unjustified chargeback may result in suspension or termination of your account.

Babliy owns the platform, brand, and software. You may not copy, reverse engineer, or resell the service except as expressly permitted. Your content remains yours as described in section 3. Marketing images and copy on babliy.ai are owned by us or used under license; do not scrape or reuse them without permission.

Babliy may generate automated replies and creative using AI. These outputs may be inaccurate or inappropriate in edge cases. You are responsible for reviewing automated messages where accuracy matters (pricing disputes, refunds, legal claims, medical or safety topics). Turn off the agent or take over the chat when needed. We do not guarantee sales results, rankings, or ROI.

Babliy is provided "as is." We do not guarantee uninterrupted service, specific business outcomes, or that AI-generated replies are always accurate. We are not responsible for third-party outages, policy enforcement, or number quality issues outside our control.

To the fullest extent permitted by law, Babliy is not liable for indirect, incidental, special, or consequential damages, or for lost profits, revenue, or data. Our total liability for any claim relating to the service is limited to the fees you paid us in the twelve months before the claim. Some jurisdictions do not allow certain limitations; in those places our liability is limited to the maximum permitted by law.

You agree to indemnify and hold Babliy harmless from claims, damages, and expenses (including reasonable legal fees) arising from your use of the service, your content, your messaging to customers, or your violation of these terms or applicable law.

You may stop using Babliy at any time. We may suspend or terminate access if you breach these terms, fail to pay, or if required for security or legal reasons. Upon termination, your right to use the service ends. Export your data before closing your account where the product allows.

These terms are governed by the laws of Morocco, without regard to conflict-of-law rules. Disputes will be resolved in the courts of Agadir, Morocco, unless mandatory local consumer protections apply to you.

We may update these terms. We will post the new date at the top and, for material changes, provide notice in the app or by email. Continued use after changes means you accept the updated terms where permitted by law.
